Although these free resources provide some information on arrest records, they have significant limitations. Most of these sites do not contain older arrest data and often do not include people who were booked into jail and then quickly released. In addition, searchers trying to locate a record that has been sealed or expunged will most likely not find any record. Typically, no identification is needed to run an online search. However, law enforcement agencies may ask for identification when making in-person access requests.

True removal of an individual’s criminal history record is possible for a very small number of criminal convictions under Wisconsin law. This is because under Wisconsin Statutes sections 973.015 & 938.355, true removal can occur only for offenses committed when:

  • The defendant was under 25 years of age, and
  • The maximum sentence did not exceed 6 years.

Removal of most arrest records will require a legal basis. Wisconsin Law does not permit individuals to have accurate records deleted from Public Records, and therefore, there are many fewer options than you would expect.
